A K-1 case begins with more than forms. Relationship history, previous immigration filings, supporting evidence, and plans to marry can shape how the petition should be prepared. At Ross & Pines, we tailor our legal strategy to each couple’s circumstances and guide clients through every stage of the fiancé(e) visa process.

Our immigration practice has helped hundreds of clients navigate the United States immigration system. Our attorneys bring more than 100 years of combined legal experience and are AV-Rated by Martindale-Hubbell, its highest peer-review rating for legal ability and ethical standards.

Who May Pursue a K-1 Fiancé(E) Visa?

A K-1 nonimmigrant visa allows the fiancé(e) of a United States citizen to enter the country to marry. The citizen petitioner starts the process by filing an I-129F petition. Both partners must intend to marry within 90 days of entry.

The intended marriage must be bona fide: the couple must plan to build a genuine life together rather than marry solely to obtain an immigration benefit. The government assesses the relationship and the couple’s eligibility through the petition, supporting records, and interview responses.

Fiancé(E) Visas vs. Marriage-Based Visas

Marital status determines which immigration path applies. The K-1 route is designed for an engaged couple planning to marry after the noncitizen partner enters the United States. Couples who are already married generally use a CR-1 or IR-1 marriage-based immigrant visa process.

These paths involve different forms and procedural steps. We review the couple’s marital status, plans, relationship history, and previous immigration matters before recommending an appropriate course.

The K-1 Visa Process for Atlanta Couples

The process moves through several government agencies. Agency workloads, requests for additional evidence, consular scheduling, and case-specific issues can affect each stage, but the sequence generally remains consistent.

The principal stages include:

  • I-129F petition: The citizen petitioner submits the petition and supporting evidence.
  • National Visa Center processing: After approval, the case proceeds through the National Visa Center before consular processing.
  • Consular interview: The applicant completes the required steps and attends an interview at the applicable United States embassy or consulate.
  • Visa issuance and travel: If the visa is issued, the applicant may travel to a United States port of entry and request admission.
  • Marriage deadline: The couple must marry before the K-1 status period expires.

A K-1 visa holder may seek admission once during the visa’s validity period. That period is no more than six months from issuance, although the visa should be checked for its specific expiration date. Issuance doesn’t guarantee admission because immigration officials make that determination at the port of entry.

K-1 and K-2 status expires 90 days after admission and can’t be extended. If the couple doesn’t marry and the visa holder remains after status expires, that person may face removal consequences and impaired eligibility for future immigration benefits.

Documents & Evidence for a K-1 Visa Petition

The couple generally must show that they met in person during the two years before filing the I-129F petition, subject to limited exceptions under immigration law. They must also document their intent to marry within the required period after admission.

Relationship evidence may include photographs together, travel documentation, communications, and written statements about the relationship and wedding plans. We help clients identify materials that accurately reflect their circumstances rather than relying on a generic document package.

Personal and consular records generally include:

  • A passport valid for at least six months beyond the intended stay
  • A birth certificate
  • Divorce decrees or death certificates for prior spouses, when applicable
  • Police certificates from the country of residence and countries where the applicant lived for six months or longer after age 16
  • Documentation from the required medical examination

Financial Support Documentation
The process also requires financial evidence, including an I-134 declaration. For 2026, the federal poverty guideline for a household of two in the 48 contiguous states is $21,640. This figure provides a baseline when evaluating income sufficiency for the I-134 and later I-864 submissions, but the applicable standard and evidence depend on household size and individual circumstances.

Immigration Steps After the K-1 Marriage

After marrying the citizen petitioner within the required period, the foreign spouse becomes an immediate relative and may seek lawful permanent resident status through adjustment of status. This process allows an eligible applicant to seek permanent residence from within the United States using an I-485 application.

Immigrant visas for immediate relatives are immediately available, so this category isn’t subject to annual visa-number backlogs. Approval still depends on meeting the applicable eligibility, documentation, and admissibility requirements.

An adjustment-of-status applicant may also seek employment authorization with an I-765 application and advance parole with an I-131 application. Advance parole may permit travel while adjustment is pending, but approval isn’t assured. International travel should be evaluated carefully before departure.
