The 30-Day ALS Deadline You Can’t Afford to Miss

After any DUI arrest in Georgia, you have exactly 30 calendar days from the date of arrest to either request an administrative license suspension (ALS) hearing with the Department of Driver Services (DDS) or install an ignition interlock device (IID). That deadline doesn’t wait for your court date. Miss it, and your license is automatically suspended before the criminal case is anywhere near resolved.

Second DUI Within 10 Years

A second DUI remains a misdemeanor but carries a mandatory minimum of 72 hours in jail, with a potential sentence of up to one year. Fines run $600 to $1,000, and you face a minimum of 240 hours of community service and a mandatory IID. If the second arrest falls within five years of the first, additional consequences apply: a three-year license suspension, seizure of license plates, and publication of your photograph in a local newspaper.

Third DUI Within 10 Years

A third offense elevates to a high and aggravated misdemeanor, a classification that sits above a standard misdemeanor under Georgia law. The mandatory minimum jumps to 15 days in jail, fines increase to $1,000 to $5,000, and the license suspension extends to five years. Community service minimums stay at 240 hours. Your name, address, and photograph are published in a local newspaper at your expense. A third offense within five years also carries a habitual violator designation.

Fourth or Subsequent DUI Within 10 Years

Under O.C.G.A. 40-6-391, a fourth DUI is a felony. The sentence runs from one to five years, with all but 90 days subject to probation, along with five years of supervised probation and fines of $1,000 to $5,000. License revocation is permanent, though a restricted license may become available after two years. The state may also pursue vehicle forfeiture. Any DUI following a felony conviction within the 10-year window is charged as a felony as well.
