Two Ways to Establish EB-2 Eligibility

Applicants generally establish underlying eligibility as an advanced-degree professional or a person with exceptional ability. That is only part of the analysis. The offered position, proposed endeavor, supporting evidence, and filing structure must also satisfy the applicable requirements.

Advanced-Degree Professionals

An advanced-degree case may rely on a U.S. master’s degree or higher, an equivalent foreign degree, or a bachelor’s degree followed by qualifying progressive experience. Progressive experience involves work reflecting greater knowledge and responsibility after the applicant earned the bachelor’s degree. The record must also connect that education and experience to the position or professional field at issue.

Individuals With Exceptional Ability

Exceptional ability means ability significantly above the level ordinarily encountered in the sciences, arts, or business. Supporting evidence may include academic records, documentation of professional experience, and proof of licensing, compensation, memberships, or recognized achievements.

Meeting one evidentiary criterion doesn’t guarantee approval. U.S. Citizenship and Immigration Services (USCIS) evaluates the complete record under the governing standard. We therefore base each immigration strategy on the client’s background rather than applying a standard template.

How Employer-Sponsored EB-2 Cases Proceed

A standard employer-sponsored case generally begins with a permanent job offer and PERM labor certification. Through the PERM process, the employer tests the U.S. labor market under Department of Labor rules. After certification, the sponsoring employer generally files Form I-140, Immigrant Petition for Alien Workers.

The petition seeks the requested immigrant classification and establishes or preserves a priority date, which determines the applicant’s place in the immigrant visa queue. When a visa number becomes available, the applicant may pursue adjustment of status within the United States or consular processing through a U.S. embassy or consulate abroad.

Availability varies by category, country of chargeability, and priority date. Applicants should consult the current Department of State Visa Bulletin and USCIS guidance rather than rely on fixed timeline estimates.

How a National Interest Waiver Changes the Process

A National Interest Waiver changes the usual sponsorship structure. A qualifying applicant may self-petition without a permanent job offer or PERM labor certification but must first establish eligibility through the advanced-degree or exceptional-ability route.

USCIS generally considers three central issues:

  • Whether the proposed endeavor has substantial merit and national importance.
  • Whether the applicant is well positioned to advance that endeavor.
  • Whether, on balance, waiving the job-offer and labor-certification requirements would benefit the United States.

The analysis requires more than an impressive résumé. The record must define the proposed endeavor, establish its broader significance, show how the applicant is prepared to advance it, and explain why the waiver is justified. Building a Consistent, Well-Supported EB-2 Filing

A coherent filing connects the applicant’s education, work history, proposed position or endeavor, and supporting documentation. Evidence requirements differ among employer-sponsored petitions, exceptional-ability cases, and National Interest Waiver filings.

Requests for evidence and notices of intent to deny identify government concerns or missing proof. Prior denials and complex immigration histories may require focused responses that address the agency’s questions without creating new inconsistencies.
