Georgia Charges Behind the Aggravated DUI Label

Georgia’s DUI statute covers driving under the influence of alcohol, drugs, or other intoxicating substances. When additional circumstances are involved, prosecutors may file separate traffic or criminal charges rather than a formally named aggravated DUI charge.

Serious DUI-related allegations may include:

  • Serious injury by vehicle: A person accused of causing an accident and specified bodily harm while violating Georgia’s DUI law may face this separate felony charge. A conviction can carry one to 15 years in prison.
  • Homicide by vehicle: A death allegedly caused by DUI-related conduct may support a homicide-by-vehicle charge. The classification and potential consequences depend on the charged traffic violation and other facts.
  • Child endangerment: Transporting a child under 14 while committing a qualifying DUI can create a separate offense. That count doesn’t merge with the DUI for prosecution and sentencing.
  • Repeat DUI offenses: Prior convictions can affect classification and sentencing. Georgia treats a third DUI differently from a fourth or subsequent offense, making the identity, date, and legal status of each conviction important.

When One DUI Arrest Leads to Multiple Charges

Prosecutors must support each count with evidence establishing its required elements. Our review separates the allegations and examines the evidence behind each one.

Facts that may increase the potential consequences include:

  • A collision resulting in an alleged serious bodily injury
  • A crash involving a fatality
  • A passenger who was under 14
  • Prior DUI convictions used to support repeat-offense treatment

  • Drug-related impairment or possession allegations

When an injury or death is alleged, the analysis extends beyond whether alcohol or drugs were present. Causation, accident evidence, witness accounts, medical records, and whether the harm meets the statutory definition can become central issues.

A DUI Arrest Can Trigger Two Separate Proceedings

The criminal case determines whether the state can prove the charged offenses. At the same time, the Georgia Department of Driver Services may separately address the person’s driving privileges.

An Administrative License Suspension is a civil process that may follow a qualifying chemical-test result or refusal of a state-administered test. Its requirements and consequences vary based on the test or refusal allegation, driving history, and eventual case disposition. We handle these license matters alongside the criminal defense.

Felony-level charges arising in Fulton County may proceed in Fulton County Superior Court, which handles felony cases in the Atlanta Judicial Circuit. Because the criminal and license proceedings can follow different schedules, resolving one doesn’t necessarily resolve the other.
