Student Visa Lawyer in Atlanta

F-1, J-1 & M-1 Visa Guidance from Attorneys Who Handle the Full Picture

Applying for a student visa involves more than completing forms. It requires understanding which visa category fits your situation, meeting documentation requirements, and knowing how your full immigration and personal history could affect the outcome. At Ross & Pines, our Atlanta immigration attorneys guide F-1, J-1, and M-1 applicants through each stage of the process with strategies built around their individual circumstances.

What sets our approach apart is that we handle both immigration and criminal defense matters. That means we can assess how a prior arrest, charge, or complicated immigration history might affect a student visa case before it becomes a problem at the consulate or with USCIS.

If you’re applying for a student visa or navigating a complication with your status, call our Atlanta immigration team at (404) 812-4300 to schedule a free attorney strategy session.

Which Student Visa Do You Need?

The three nonimmigrant student visa categories serve different educational purposes, and the type of school and course of study you intend to pursue determines which one applies to you.

  • F-1 Visa: For academic study or research at an accredited college, university, high school, or other approved institution. This is the most common student visa for degree-seeking international students.
  • J-1 Visa: For participants in work-and-study exchange visitor programs. It’s frequently used for medical training, business programs, and other structured exchange arrangements.
  • M-1 Visa: For students pursuing vocational or non-academic coursework at a technical or trade school.

Choosing the wrong category can delay or derail your plans. Our attorneys review your program, institution, and goals before advising on which visa path makes the most sense for you.

Baseline Eligibility Requirements

Regardless of visa category, applicants share a common set of threshold requirements.

  • Accepted by an SEVP-Approved School: F-1 and M-1 applicants must have an offer of enrollment from a school certified by the Student and Exchange Visitor Program before the visa application can proceed.
  • English Proficiency: You must demonstrate fluency in English or show enrollment in a program designed to build that proficiency.
  • Sufficient Financial Support: Applicants must show they have adequate funds to cover tuition, fees, and living expenses throughout their program.
  • Nonimmigrant Intent: Every student visa applicant must demonstrate an intent to return home after completing their degree or course of study. Consular officers scrutinize this requirement closely.

The Student Visa Application Process

The procedural steps are consistent across F-1, J-1, and M-1 applications, though each has category-specific details. Here’s what the process generally involves.

School Acceptance Documents & SEVIS Fee

Once accepted, your school issues Form I-20 (for F-1 and M-1 students) or Form DS-2019 (for J-1 exchange visitors). This document is required both to apply for the visa and to enter the United States. Before submitting your application, you must pay the SEVIS I-901 fee to register in the Student and Exchange Visitor Information System.

DS-160 Application & Visa Interview

The next step is completing the DS-160 online application, the standard nonimmigrant visa form used by U.S. consulates and embassies worldwide. After submission, you’ll schedule a visa interview at the U.S. consulate or embassy serving your home country. The interview is often the most consequential part of the process. Preparation matters.

When Your Case Is More Complicated

Not every student visa application is straightforward. Students and exchange visitors in Atlanta regularly face situations that require careful legal analysis: a Request for Evidence, a prior visa denial, an overstay on a previous status, or a criminal record that could trigger inadmissibility grounds.

Because our firm also handles criminal defense, our attorneys understand how arrests and convictions interact with immigration law in ways that a firm handling only immigration work may not. If you have a prior charge or a complex immigration history, we can evaluate its potential impact on your case and advise you honestly before you file, not after something goes wrong.

We also assist students who need guidance on maintaining lawful F-1 or M-1 status after arrival, including questions about authorized periods of stay, employment authorization, and program extensions.

How We Handle Student Visa Cases

Carlos E. Solomiany has led the immigration practice at Ross & Pines since 2007 and is bilingual, allowing us to serve Spanish-speaking clients throughout the process. His experience spans both routine applications and contested matters requiring formal advocacy before immigration courts or on appeal.

We don’t promise outcomes or encourage shortcuts. What we do is give you an honest assessment of what the law allows, identify the risks in your specific situation, and build a filing strategy tailored to your record and goals. When a student visa matter escalates to a hearing or appeal, we’re prepared to represent you there as well.
